- Objet et acceptation
La présente Politique d’utilisation (ci-après « les Conditions ») régit l’accès et l’utilisation de la plateforme
AiCom (ci-après « la Plateforme »), exploitée par
Axepta SA, société basée à Genève, Suisse.
En accédant à la Plateforme ou en l’utilisant, l’utilisateur (ci-après « l’Utilisateur ») reconnaît avoir lu, compris et accepté l’intégralité des présentes Conditions.
L’acceptation des présentes Conditions est obligatoire pour toute utilisation des services proposés par AiCom.
- Description du service
AiCom est une plateforme SaaS permettant la
génération automatisée de contenus visuels et textuels pour les réseaux sociaux, ainsi que la
planification et la
publication automatisée de ces contenus.
Les principales fonctionnalités incluent :
- la génération d’images et de textes,
- la planification automatisée de publications,
- la publication automatisée sur divers réseaux sociaux,
- la suggestion et l’édition de textes,
- la modification des images générées.
AiCom s’appuie sur des
technologies tierces, notamment des API d’intelligence artificielle et de réseaux sociaux, pour fournir ses services.
- Accès au service
L’accès à la Plateforme AiCom est ouvert aux
professionnels (B2B) et aux
particuliers.
L’Utilisateur doit disposer d’un
compte personnel pour accéder aux fonctionnalités.
AiCom se réserve le droit de refuser, suspendre ou supprimer tout compte en cas de non-respect des présentes Conditions ou d’utilisation abusive.
Une
période d’essai gratuite de 14 jours est proposée. Durant cette période, les contenus générés comportent un filigrane (« watermark ») indiquant leur création via AiCom.
- Utilisation du service
L’Utilisateur s’engage à utiliser la Plateforme conformément à la législation en vigueur et aux présentes Conditions.
Il est notamment
interdit de :
- utiliser AiCom à des fins illégales, diffamatoires, offensantes, pornographiques ou discriminatoires ;
- porter atteinte aux droits de tiers ;
- détourner, modifier, copier ou revendre tout ou partie du service sans autorisation ;
- nuire au bon fonctionnement technique de la Plateforme.
AiCom se réserve le droit de
suspendre ou résilier immédiatement le compte de tout Utilisateur en cas de violation de ces règles.
- Comptes utilisateurs
Chaque compte est strictement personnel. L’Utilisateur est responsable de la confidentialité de ses identifiants et de toute activité effectuée via son compte.
Toute utilisation non autorisée doit être signalée immédiatement à AiCom (
contact@aicom.ch).
- Abonnements, paiement et résiliation
Les services AiCom sont accessibles via des abonnements
mensuels ou annuels, gérés par
Stripe.
- Paiement
Le paiement est exigible à l’avance pour chaque période d’abonnement.
- Annulation et non-remboursement
- Les abonnements mensuels peuvent être résiliés avant la fin du mois en cours.
- Les abonnements annuels peuvent être annulés avant leur échéance, mais aucun remboursementn’est effectué. L’accès reste actif jusqu’à la fin de la période payée.
- Fin de l’abonnement
À la fin d’un abonnement, AiCom maintient le compte actif durant
30 jours avant désactivation. Passé ce délai, le compte et les données associées pourront être supprimés.
- Propriété intellectuelle
- Droits sur la Plateforme
AiCom conserve l’intégralité des droits de propriété intellectuelle relatifs à sa technologie, son code source, son design, ses algorithmes, et à tout élément composant la Plateforme.
- Droits sur les contenus générés
Les contenus (textes, images, publications) créés par les Utilisateurs via AiCom sont leur
propriété exclusive.
AiCom conserve uniquement une
licence technique non exclusive permettant l’hébergement, l’affichage et la maintenance du service.
- Responsabilité et garanties
Le service AiCom est fourni
« tel quel » (« as is »), sans garantie d’exactitude, de disponibilité ou d’adéquation à un usage particulier.
AiCom ne saurait être tenue responsable :
- des interruptions ou erreurs de fonctionnement,
- des pertes de données,
- des dommages directs ou indirects résultant de l’utilisation du service ou des contenus générés.
La responsabilité d’AiCom, si elle venait à être engagée, est en tout état de cause
limitée au montant total payé par l’Utilisateur au cours des douze (12) derniers mois.
- Protection des données
L’utilisation du service implique le traitement de certaines données personnelles.
AiCom s’engage à respecter la réglementation applicable, notamment le
Règlement général sur la protection des données (RGPD) et la
Loi fédérale suisse sur la protection des données (LPD).
Une
politique de confidentialité distincte précisera les modalités de collecte et de traitement.
- Modification du service et des conditions
AiCom se réserve le droit de
modifier ou d’améliorer les fonctionnalités de la Plateforme à tout moment.
Les présentes Conditions peuvent également être modifiées.
Toute modification substantielle fera l’objet d’une notification à l’Utilisateur.
La poursuite de l’utilisation du service après notification vaut acceptation des nouvelles Conditions.
- Droit applicable et juridiction compétente
Les présentes Conditions sont régies par le
droit suisse.
Tout litige relatif à leur interprétation ou à leur exécution relève de la compétence exclusive des
tribunaux de Genève (Suisse).

AiCom Terms of Use

- Purpose and Acceptance
These Terms of Use (hereinafter referred to as “the Terms”) govern access to and use of the
AiCom platform (hereinafter referred to as “the Platform”), operated by
AiCom, based in Geneva, Switzerland.
By accessing or using the Platform, the user (hereinafter referred to as “the User”) acknowledges having read, understood, and accepted all of these Terms.
Acceptance of these Terms is required for any use of the services provided by AiCom.
- Description of the Service
AiCom is a SaaS platform that enables the
automated generation of visual and textual content for social media, as well as the
automatic scheduling and
publishing of such content.
Main features include:
- generation of images and texts,
- automatic scheduling of posts,
- automated publishing across various social networks,
- text suggestion and editing,
- image modification and customization.
AiCom relies on
third-party technologies, including artificial intelligence and social network APIs, to deliver its services.
- Access to the Service
Access to the AiCom Platform is open to both
business users (B2B) and
individual users.
Each User must have a
personal account to access the Platform’s features.
AiCom reserves the right to refuse, suspend, or delete any account in the event of non-compliance with these Terms or misuse of the service.
A
14-day free trial is available. During this trial period, any content generated will include a watermark indicating that it was created with AiCom.
- Use of the Service
The User agrees to use the Platform in compliance with applicable laws and these Terms.
In particular, it is
strictly prohibited to:
- use AiCom for illegal, defamatory, offensive, pornographic, or discriminatory purposes;
- infringe upon the rights of third parties;
- modify, copy, or resell any part of the service without authorization;
- disrupt or attempt to harm the technical operation of the Platform.
AiCom reserves the right to
suspend or terminate the User’s account immediately in case of violation of these provisions.
- User Accounts
Each account is strictly personal. The User is responsible for maintaining the confidentiality of login credentials and for all activity conducted under their account.
Any unauthorized use must be reported immediately to AiCom (camelia@aicom.ch).
- Subscriptions, Payment, and Termination
Access to AiCom services is subject to
monthly or annual subscriptions, managed through
Stripe.
- Payment
Payment is due in advance for each subscription period.
- Cancellation and Non-Refundability
- Monthly subscriptions may be cancelled before the end of the current month.
- Annual subscriptions may be cancelled before the end of the term; however, no refundswill be issued. Access remains available until the paid term expires.
- End of Subscription
At the end of a subscription, AiCom keeps the account active for
30 days before deactivation. After this period, the account and associated data may be deleted.
- Intellectual Property
- Rights to the Platform
AiCom retains all intellectual property rights to its technology, source code, design, algorithms, and all components of the Platform.
- Rights to Generated Content
Content (texts, images, posts) created by Users through AiCom remains the
exclusive property of the User.
AiCom only retains a
non-exclusive technical license for the purpose of hosting, displaying, and maintaining the service.
- Liability and Warranties
The AiCom service is provided
“as is”, without any guarantee of accuracy, availability, or fitness for a particular purpose.
AiCom shall not be held liable for:
- interruptions or operational errors,
- data loss,
- direct or indirect damages arising from the use of the service or generated content.
If AiCom’s liability were to be incurred, it shall in any case be
limited to the total amount paid by the User during the previous twelve (12) months.
- Data Protection
Use of the service involves the processing of certain personal data.
AiCom undertakes to comply with applicable data protection regulations, including the
General Data Protection Regulation (GDPR) and the
Swiss Federal Data Protection Act (LPD/FADP).
A separate
Privacy Policy will specify the terms of collection and processing.
- Modifications to the Service and the Terms
AiCom reserves the right to
modify or enhance the Platform’s features at any time.
These Terms may also be updated.
Any substantial modification will be communicated to Users.
Continued use of the service following such notification constitutes acceptance of the revised Terms.
- Governing Law and Jurisdiction
These Terms are governed by
Swiss law.
Any dispute relating to their interpretation or execution shall fall under the
exclusive jurisdiction of the courts of Geneva, Switzerland.
